Purpose
These terms govern access to and use of Fitness Vendor, a conversational, omnichannel AI agent for lead qualification and appointment booking for local businesses, published by FV - Fitness Vendor.
Service description
Fitness Vendor replies to the business's leads on its channels (WhatsApp, Instagram, Messenger, SMS, email, website chat), in the name and under the brand of the business, and books appointments in its calendar based on its real availability. The service is white-label: it stays invisible to leads.
Subscription and pricing
The service is offered at €99.99 excl. VAT per month and per location, with no commitment, after a free 7-day trial. The subscription includes 200 conversations per calendar month; a conversation counts once in the month as soon as the AI agent has replied in it. Beyond that, the customer may buy top-ups of 100 conversations at €19.90 excl. VAT each, one at a time or through automatic top-up, which the customer switches on themselves; no top-up is ever bought without their action. Top-ups are added to the next subscription invoice. Without a top-up, once the 200 conversations are reached, new conversations receive an automatic acknowledgement, and ongoing conversations are never cut off. The subscription can be cancelled at any time and remains active until the end of the current period.
Development on request
During the first three months of their subscription, the customer may request the development of a missing feature. FV - Fitness Vendor reviews each request with them and answers with an agreement, a reasoned refusal or an indicative timeline. A request may be refused if it falls outside the scope of the service, depends on a third-party tool that does not allow it, or requires disproportionate work. No delivery timeline is guaranteed. A feature developed remains the property of FV - Fitness Vendor and may be offered to all its customers. Such developments change neither the price nor the term of the subscription.
Client obligations
The client is responsible for the accuracy of the information they configure (offers, prices, availability), for connecting their own channels and calendar, and for complying with the rules applicable to those channels (in particular Meta's policies for WhatsApp). The client warrants that they hold the rights required over the accounts they connect.
Availability and maintenance
FV - Fitness Vendor strives to keep the service available 24/7. Interruptions may occur for maintenance or due to external dependencies (channels, calendars, third-party providers).
Liability
Fitness Vendor applies programmatic validation to any message containing a price or a slot: information that does not come from the client's price list or real calendar is not sent. The client remains responsible for configuring their offers and calendar and for the content delivered under their brand.
Termination
The client can cancel at any time from their dashboard. FV - Fitness Vendor may suspend or terminate access in the event of a breach of these terms or non-compliant use.
Governing law
These terms are governed by French law. Any dispute falls under the competent courts of the publisher's registered office, subject to mandatory legal provisions.
